Terms of Service
Terms and conditions governing your use of urosculpt.com.
Effective date: June 15, 2026 · Last updated: June 15, 2026
These Terms of Service (“Terms”) govern your access to and use of urosculpt.com and the related pages, forms, online courses, certification programs, and provider tools operated by UroSculpt™ (“UroSculpt,” “we,” “us,” or “our”) (collectively, the “Site”). Please read them carefully.
1. Acceptance of These Terms
By accessing or using the Site, applying for certification, enrolling in a course, or otherwise interacting with our services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.
2. Who We Are
UroSculpt™ is a certification and training organization for non-surgical penile augmentation. We provide educational content, online and in-person courses, examinations, and credentials for licensed medical professionals, and we operate a directory that helps the public locate independently owned clinics and providers who hold a UroSculpt™ credential. UroSculpt™ is not a healthcare provider, does not practice medicine, and does not provide medical treatment to patients.
3. Eligibility
You must be at least 18 years old to use the Site. To apply for certification or enroll in clinical training, you must be a licensed medical professional in good standing and authorized to perform the relevant procedures in your jurisdiction. You are responsible for ensuring that your participation complies with the laws, regulations, and licensing rules that apply to you.
4. Medical Disclaimer — No Medical Advice
All content on the Site is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Using the Site, reading our content, or contacting us does not create a doctor–patient relationship. Procedures discussed on the Site carry risks, and individual results vary. Patients should always consult a qualified, licensed provider, and providers remain solely responsible for the clinical care they deliver and for exercising their own independent professional judgment.
5. Provider Directory
Clinics and providers listed in our directory are independent businesses, not employees, agents, or partners of UroSculpt™. A UroSculpt™ credential indicates that a provider completed our training or certification requirements; it is not a guarantee of any particular outcome, skill, or standard of care, and it does not constitute a medical license. UroSculpt™ does not provide, supervise, or control the care delivered by listed providers and is not responsible or liable for their acts, omissions, or the results of any treatment. Any arrangement you make with a provider is solely between you and that provider.
6. Courses, Examinations, and Certification
- Enrollment and accounts. Some services require you to register or create an account. You agree to provide accurate information, keep your credentials confidential, and remain responsible for all activity under your account.
- Nature of certification. Certification reflects completion of our program requirements as of the date awarded. It is not a medical license, a warranty of competence, or a guarantee of clinical or financial results.
- No guarantee of results. Any examples of practice growth, revenue, patient demand, or clinical outcomes shown on the Site are illustrative only. We make no guarantee that you will achieve comparable results, which depend on factors outside our control.
- Standards and revocation. We may set, modify, and enforce certification standards and may suspend or revoke a credential for failure to meet our requirements, misuse of our marks, or conduct that we determine is inconsistent with the program.
7. Fees, Payments, and Refunds
Fees for courses, examinations, certification, and other paid services are presented at the point of purchase and are due in accordance with the terms shown there. You authorize us and our payment processors to charge the payment method you provide. Except where required by law or expressly stated at the time of purchase, fees are non-refundable; any applicable refund or cancellation terms will be those presented to you when you enroll. You agree not to initiate fraudulent chargebacks, and unpaid or disputed amounts may result in suspension of access.
8. Intellectual Property
The Site and its content — including text, graphics, course materials, videos, logos, and the UroSculpt™ and UroFirm™ names and marks — are owned by UroSculpt™ or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Site and to use materials made available to you solely for your own permitted, non-commercial or internal professional use. You may not copy, reproduce, distribute, modify, publicly display, resell, or create derivative works from our content, or use our names or marks, without our prior written permission.
9. User Submissions
If you submit content to us — such as form responses, application details, or reviews — you represent that it is accurate and that you have the right to provide it, and you grant UroSculpt™ a non-exclusive, worldwide, royalty-free license to use, store, and process that content to operate and improve our services. You agree not to submit content that is unlawful, infringing, misleading, or otherwise objectionable.
10. Acceptable Use
You agree not to: (a) use the Site in violation of any law or regulation; (b) attempt to gain unauthorized access to the Site, accounts, or systems; (c) interfere with or disrupt the integrity or performance of the Site; (d) scrape, harvest, or collect information about others without authorization; (e) misrepresent your identity, credentials, or affiliation with UroSculpt™; or (f) use our content or marks in a way that is deceptive or that implies endorsement we have not given.
11. Third-Party Links and Services
The Site may contain links to third-party websites, services, and partners that we do not control. We provide these links for convenience and are not responsible for the content, products, or practices of any third party. Your use of third-party services is governed by their own terms and policies.
12. Disclaimer of Warranties
The Site and all content and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any content is complete or current.
13. Limitation of Liability
To the fullest extent permitted by law, UroSculpt™ and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site, the directory, or our services. To the fullest extent permitted by law, our total liability for any claim relating to the Site or these Terms will not exceed the greater of the amount you paid to us in the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US$100).
14. Indemnification
You agree to indemnify and hold harmless UroSculpt™ and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law, or, for providers, the clinical care and services you deliver.
15. Dispute Resolution, Binding Arbitration, and Class-Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court, to have a jury trial, and to participate in a class action.
15.1 Governing law
These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of California and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-laws principles.
15.2 Informal resolution first
Before starting an arbitration or any other proceeding, you agree to first try to resolve the dispute informally by sending written notice to us at [email protected] that describes the dispute and the relief you seek. We will attempt to do the same. If the dispute is not resolved within sixty (60) days after the notice is received, either party may proceed as set out below. Completing this informal-resolution process is a condition that must be met before either party may begin arbitration.
15.3 Binding arbitration
Except for the claims described in Section 15.6, you and UroSculpt™ agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our content, courses, examinations, certification, the provider directory, or our services will be resolved exclusively by final and binding arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its rules then in effect, including the Consumer Arbitration Rules where they apply. The arbitration will be conducted by a single arbitrator and will take place in Sacramento County, California — or, where the applicable rules so provide, by videoconference or in the county where you reside. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court (and not an arbitrator) will decide the enforceability of the class-action waiver in Section 15.5.
15.4 Jury-trial waiver
To the fullest extent permitted by law, you and UroSculpt™ each waive any right to a trial by jury in any proceeding arising out of or relating to these Terms or the Site.
15.5 Class-action and representative-action waiver
To the fullest extent permitted by law, you and UroSculpt™ agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, private-attorney-general, or other representative proceeding. The arbitrator may not consolidate more than one person’s claims, may not preside over any form of class or representative proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief for that party’s individual claim. If this waiver is found unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that one) will be severed and brought in a court of competent jurisdiction, while all remaining claims will proceed in arbitration.
15.6 Exceptions to arbitration
Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in the state or federal courts located in Sacramento County, California, to protect its intellectual property or confidential information. For any claim that is not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Sacramento County, California.
15.7 Coordinated or mass filings
If twenty-five (25) or more similar arbitration demands are submitted by or with the assistance of the same or coordinated counsel, the parties agree the demands will be administered in staged batches to promote efficient resolution, and any applicable limitations period will be tolled for demands awaiting their batch.
15.8 Your right to opt out
You may opt out of the arbitration agreement in Sections 15.3 through 15.7 by sending written notice to [email protected] within thirty (30) days of first accepting these Terms, stating your name and that you intend to opt out of arbitration. Opting out will not affect any other part of these Terms. If you do not opt out within thirty (30) days, you are bound by this arbitration agreement.
15.9 Survival
This Section 15 survives termination of these Terms and the end of your use of the Site.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be reflected on this page, and your continued use of the Site after an update means you accept the revised Terms.
17. Termination
We may suspend or terminate your access to the Site or to any service at any time, with or without notice, if we believe you have violated these Terms or to protect the Site, our users, or our rights. Provisions that by their nature should survive termination — including intellectual-property, disclaimer, limitation-of-liability, indemnification, and governing-law provisions — will survive.
18. General
These Terms, together with our Privacy Policy and any terms presented at the point of purchase, are the entire agreement between you and UroSculpt™ regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
